| dc.description | The purpose of this article is to determine the international obligations in terms of human rights regarding unaccompanied migrant children from their families assumed by the United States, in the same sense, a significant case of Molina Theissen Vs. Guatemala will be analyzed so that possible international liability can be established. The response of the Inter-American Court of Human Rights (IACHR) regarding the risk situation presented to minors and the impact generated by the loss of that family bond will be studied. Address the issue of Human Rights to then determine the violation that causes and hence highlight the possible responsibility of the US State, as well as, recognize the principles that were violated and violated in relation to international wrongful acts regarding the application of the migration policy and carry out a joint approach to the problem and the main causes of why these people leave Central America to migrate to the United States. In this regard, this article seeks to recognize the procedural guarantees that must be respected in the corresponding instances so that these beings are in a position to defend their rights in the face of a particularsituation that wants to affect them. | en-US |
| dc.description | Este artículo tiene como finalidad determinar las obligaciones internacionales en materia de derechos humanos respecto a las niñas y niños migrantes no acompañados de sus familias asumidas por Estados Unidos. En el mismo sentido, se analiza un caso significativo de Molina Theissen vs. Guatemala, de modo que se pueda establecer la posible responsabilidad internacional. Se estudia la respuesta de la Corte Interamericana de Derechos Humanos (CIDH) con respecto a la situación de riesgo que se le presentaba a los menores y el impacto generado por la pérdida de ese vínculo familiar. Se pretende abordar el tema de derechos humanos para luego definir la vulneración que provoca y de ahí destacar la posible responsabilidad al Estado estadounidense, así como reconocer los principios que se vieron vulnerados y violentados en relación con los hechos ilícitos internacionales en cuanto a la aplicación de la política migratoria y realizar un abordaje conjunto sobre el problema y las principales causas del porqué estas personas abandonan Centroamérica para migrar hacia Estados Unidos. Al respecto, este artículo busca reconocer las garantías procesales que deben respetarse en las instancias correspondientes. Lo anterior tiene el fin de que estos seres estén en condiciones de defender sus derechos frente a un contexto en particular que quiera afectarlos. | es-ES |
